Limitation of Liability

Any and all risks associated with the use of the tub are solely the risk of the purchaser and user and, to the fullest extent permitted by law, Firetubs shall have no obligation, responsibility or liability whatsoever for any expenses, judgments, penalties, fines, interest, direct, indirect, special, punitive, incidental or consequential costs or any other costs or damages whatsoever, arising out of, or in connection with, the use of, or the inability to use, the tub (even if Firetubs has been advised of such damages), including any loss of use, loss of business profits, business interruption, personal injury or death, property damage, costs and expenses incurred in investigating, defending or pursuing any of the foregoing and all reasonable court costs, professional fees and disbursements in respect thereof, or any other pecuniary loss whatsoever and howsoever caused or arising, including as a result of the negligence of Firetubs or any demand, complaint, grievance, suit, proceeding, investigation, dispute or claim (whether in contract or tort, including negligence), or other action whatsoever brought by a third-party. These terms shall survive and remain in full force and effect following completion of the transactions contemplated hereby.
