The purchaser acknowledges that it has inspected the tub and agrees that they have purchased the tub on an "as is, where is” basis without any representation, warranty, statement, promise, collateral agreement or condition whatsoever, whether statutory, express or implied, oral or written, as to the merchantability, description, fitness for any particular purpose, suitability, durability, marketability, condition, or quality thereof or in respect of any other matter or thing whatsoever.
